29/10/10:DAY LONG DHARNA HELD: As per the JAC call, the day long dharna was massively held, yesterday, in front of the O/o PGMT, New admin bldg, Satara road from 10.00 hrs to 17.00 hrs. The lunch hour demonstrations were also held. The DS along with other prominent leaders of the JAC Pune addressed the masses.

MARATHON MEETING WITH GM FINANCE: The DS along with CWC member met with GM finance Shri. Y.N.Singh, in his chambers yesterday, for the various pending issues and held a marathon meeting to discuss the various issues about the executives. The association held the discussion on-

  1. Restoration of IB to all applicants, which is not being given to them, since last one month. All the IB are stopped and the work in the office and field is suffering due to non availability of IB’s. The GM(fin) has now decided to give temporary advance to all the applicants for the petty works and the amount can be spent for all the minor expenses, though normally temporary advances are given for the specified works. He said the instructions have been already issued to all the field units. We appeal to all to apply for the temporary advances and if the instructions are not implemented, then the reasons for rejections with proof may be bought to the notice of DS, so that they can be thoroughly discussed with GM (F).

  2. The personal pay issue of the newly recruited JTO’s was also discussed and the association strongly pleaded for the miscommunications between the AO Pay and AO staff, who are completely responsible for the lower pay being paid to these JTO’s. These JTO’s are being paid a lower salary than their eligibility by Rs. 4000/-. It is now decided that all such JTO’s who are suffering should send their representations to the GM(F) office directly and give a copy to DS in order to pursue the cases with him and he assured that all such cases will be settled in a week’s time.

  3. The payment of MSEDCL bills through ECS was also discussed thoroughly in the meeting. It is being regularly bought to the notice of DS that the field people are constantly facing the problem in making the MSEDCL payments and meeting the deadlines of the payment schedules. In every month the staff need to be send form the field, first for the submitting the bill and then to collect the cheque for the payments. Besides making the TA/DA payments to the staff, the man hours are also being wasted for this work which would have been utilized for more productive work in the field. The discussions have also been held with the representatives of the HDFC bank. Now the process for making the payments through ECS is being formulated in consultation with the banks. We are of the opinion that, once the bills are certified by the field and sent to AO for the payments, the entire responsibility of making the timely payments lies with the AO, who can very well make the payments through the ECS. After some more deliberations we are sure that the payment of MSEDCL bills will be sorted out.

Bende, SDE (EB), and die hard member of SNEA, who bought a cheque of Rs. 48 Lakhs from one of the reputed deemed university of Pune. With his strong convincing capability and constant persuasion, Pune SSA has been successful in achieving a major breakthrough in the 1GBPS NMEICT dream project of BSNL. We are sure and confident that such more business leads will be closed by EB team in near future. Now the onus of completing the work in time frame lies with the field team. CHQ NEWS:

A THOROUGH ANALYSIS : A thorough analysis and an in depth study of likely grave consequences of the DOP&T order No.20011/1/2006-Estt(D)dated 3rd March 2008 regarding fixation of seniority— Stand of SNEA that it is not prejudiced against any section of JTOs, either direct or promotee.

The above order ipso facto is neither against nor for any particular group, neither direct recruits nor promotee. It envisages that the criterion to determine inter-se- seniority is the year of appointment and not the year of recruitment/vacancy/panel. However, implementation of this provision results in multiple anomalies, irrespective of different Groups/categories involved, in a  large organization like BSNL, wherein bulk recruitments, numbering around  4000 a year, in a cadre like JTOs are carried out on a circle wise basis.  

  • JTO cadre is a Circle cadre where the recruiting/appointing authority is CGM concerned and BSNLCO has no control over their appointment or fixation of seniority at Circle level. Recruitment to JTO cadre is done from different streams.

  • Prior to 2001, the recruitments/ appointments to the cadre of JTOs were carried out by different circles at different points of time even against same year of recruitment. But all those recruited in the same year are brought on a common seniority platform for the purpose of next higher promotion to SDE cadre. Since the recruitments and training formalities are not streamlined on an all India basis, the date of joining of the selected candidates is beyond the control of the officer appointed. The process of recruitment in the direct and promotion quota is done on different occasions by different circles. Very often, promotee quota recruitments are done prior to direct quota and sometimes the other way round.

  • Thus it is not correct conclusion that the DOP guidelines affect only a particular quota since the guidelines are not meant to protect the interest of direct quota or promotee quota, as is being made out.

  • Further, the original OM of 1986 and the clarification dated 03-03-2008 speaks about “year of appointment” and not “seniority based on date of appointment”, as is being made out.

  • Even in the direct recruitment quota, the year/date of appointment of same batch of recruitment spreads over to more than one year as happened in the case of JTOs of 2001, 2005, 2007 and 2008 recruits. This means that the 2001 batch DR JTOs, who joined in 2001 in one circle will become en-block senior to DR JTOs, who joined in 2002 in another circle, regardless of their training centre marks, and 2005 batch DR JTOs joined in 2006 will become en-block senior to those DR JTOs, who joined in 2007(only very recently this Association has been able to resolve their pay anomaly issue after strenuous efforts).

  • Similarly the 2007 batch JTOs joined in 2008 in some circles will become enbloc senior to those joined in 2009 in some other circles and 2008 batch JTOs joined in 2009 in some circles will become enbloc senior to those joined in 2010 in some other circles, irrespective of training centre marks.

  • Since the order is applicable for the appointments done after 03-03-2008, the recruitment year of 2008 batch JTOs will change from 2008 to 2009 or 2010 thereby changing their present inter-se-seniority already allotted to them at the time of their appointment.

  • Similarly the recruitment year of JTOs of 2007 batch will change from 2007 to  2008 or 2009.

  • This may lead to further litigations among the same group of JTOs of same batch appointed by different CGMs at different occasions.

  • Since JTO cadre is a circle cadre, and CGM is the recruiting/appointing authority, the selected list of one circle is not comparable with the selected list of another circle, since the candidates allotted to each circle will become the selected list of that circle, even if the selection is done at all India level through a single examination.

  • Hence this order is not in favour of any stream/group, but is likely to   create divisions among the same batch of JTOs.

  • The unfortunate stalemate created in filling up about 5000 TES Gr B vacancies through competitive examination because of issues of seniority arising among the batches of 2001, 2002 and 2005 DR JTOs are a glaring example before all of us. Today, more than 90% of 5000 TES Gr B vacancies would have been easily occupied by BSNL recruit JTOs, but, unfortunately, somehow, due to narrow considerations holding of examination is stalled due to unnecessary issues of seniority. This has not helped anyone except that it has painfully stalled promotion of more than 4000 BSNL recruit JTOs to TES Gr B. And how many efforts were put in by this Association to change over to OMR based examination to ensure fastest promotion. Let us not try to create another stalemate for promotion to TES Gr B through seniority cum fitness quota, and thereby block both the channels of promotion of JTOs to TES Gr B, competitive as well as seniority cum fitness. Let us keep in mind how 900 JTOs of 2001 batch got promotion to TES Gr B through last competitive examination and how serious and consistent efforts were made by some BSNL 2001 JTOs to stall holding of last competitive examination also by filing number of Court cases which were successfully contested by this Association. Let all of us exercise restraint and act with prudence and patience.    

  • Similarly the impact of the order on other cadres also require in depth analysis.

It is therefore amply clear that the stand of the Association that the implementation of DOP&T guidelines dated 3rd Mach 2008 in an organization like BSNL requires an indepth and thorough analysis to understand the actual impact is in larger interest of the cadre of JTO in general to avoid stalemate in their promotion to TES Gr B. Our stand has to be seen and analyzed in a much broader and deeper perspective. This stand is not intended at all to harm or favour any particular stream or Group, but is only aimed to ensure that a prolonged stalemate in promotion from JTO to TES Gr B through seniority cum fitness is avoided under all circumstances.

17/10/10:JTO TO SDE DPC: ACRs and VC from A&N, AS, BR, BSNLCO, BRBRAITT, CHG, CHTD, ETR, GUJ, HR, HP, JKD, J&K, KRL, KOL TD, MH, NE-I, NE-II, NTP, NTR, PB, STP, STR, TN, UKD, UP(E), WB, WTP, WTR, ITPC and T&D Circles are not received so far. BSNLCO has directed to keep the ACRs ready by 31.05.2010. Inspite of repeated reminders from CHQ, our CSs are failed to sent the ACRs even after 5 months thereby delaying the first promotion of JTOs recruited in 1994 and 1995 and completed almost 15 years of service as JTOs. All the CSs are directed to meet the CGMs immediately and camp at Circle office till the ACRs are dispatched to BSNLCO by hand. All CSs/CHQ office-bearers should give a day to day report to the GS.

ALL INDIA ELIGIBILITY LIST OF JTOS: The gradation list particulars called for from the Circles for the preparation of another AI Eligibility list has received only from BRBRAITT, DNW, J&K, NTP, NTR, NCES, STR and T&D circles. CSs are once again requested to sent the gradation list particulars urgently. The soft copy may be mailed to Pers II section without further delay. Since the Circle Gradation list is already available in all the Circles, CHQ is unable to understand the undue delay in sending the same to BSNLCO.

Hunger strike by General Secretaries at BSNLCO: As per the decision of the JAC, GS/SNEA(I) and other General Secretaries went on a one day hunger strike today at BSNLCO, New Delhi, demanding immediate payment of bonus to the Non-Executives and Executives of BSNL. On behalf of the management, acting CMD & Director (CM), Shri R. K. Agarwal invited the leaders for discussion. After detailed discussion, the Director (CM) assured that our demand for payment of bonus would be strongly taken up again in the next Board meeting. Inspite of the assurance given by the management, the leaders continued their fast till the evening. Based on the assurance given by the acting CMD, JAC decided to postpone the nationwide Dharna on 19.10.2010 to 28.10.2010.

15/10/10:CASE OF PERSONAL PAY OF NEWLY RECRUITED JTO’s: The Association met the GM & DGM finance on the issue of fixation of Personal pay to the newly recruited JTO, who are getting Rs. 4500/ less salary in the revised pay scale. Though there are clear guidelines from the corporate office to give personal pay to all newly recruited JTO’s in order to protect their pay in the scale of 9850(revised) to 16400. But blatantly the guidelines were violated. The association intervened and insisted to follow the guidelines to which the instructions were issued to pay the personal pay to all the newly recruited JTO’s. All the new JTO’s are requested to check their salary details and see that the PP is added in the salary in next month along with the arrears. The discrepancies may be bought to the notice of DS/ ADS.

JAC FINALISES STRIKE NOTICE – DATES OF STRIKE AND MARCH TO PARLIAMENT CHANGED:

The JAC meeting took place yesterday the 12.10.10, at New Delhi. In the meeting, the demands to be incorporated in the 3 day strike notice were finalized. The JAC has made a change in the dates of the 3 day strike. This was necessitated due to the fact that the counting of votes for Bihar Assembly elections is to take place  on 24.10.2010. Similarly, the date for  “March to the Parliament” is also changed in view of the fact that the US President is visiting Delhi and will be addressing the Indian Parliament. Now, the final dates of the strike and “March to Parliament” will be as follows.

3 days strike           -        1st, 2nd and 3rd December, 2010

“March to Parliament” -        15th November, 2010

Circle and District Secretaries are requested to make fullest mobilization for the Strike and “March to the Parliament”.

BONUS ISSUE – JAC GIVES CALL FOR AGITATION:

In the JAC meeting held yesterday, the 12.10.2010, it was decided to take up the bonus issue with CMD BSNL. It was decided to immediately meet the CMD and discuss the issue. Accordingly, the leaders of the JAC met the CMD and strongly argued for bonus payment to all the Non-Executives and Executives immediately. However, CMD rejected the demand. Thereafter, JAC again met and took the following decision for agitation programme.

15.10.2010 -- One day hunger, strike by all the General Secretaries, at BSNL CO, New Delhi.

      19.10.2010 -- One day dharna throughout the country

07/10/10:ASSOCIATION MEETS EPF COMMISSIONER: The DS along with ADS met the Shri. Padmanabhan, Regional Commissioner EPF, Pune, and discussed in details about the problems and pending issues with them. We discussed in details about the problems faced in EPF issues and the solicited for necessary action to merge multiple accounts and transfer them to Mumbai. He has assured of full cooperation from EPFO in order to resolve the BSNL executives EPF cases. Dear comrades, this is a major breakthrough for us in order to get the long pending issues resolved. This is a challenging task and volunteers are called form Amravati, Latur, Jalgaon and Nanded.
