CASE AT HON CAT, CHENNAI ON BSNLMS RR: Final argument completed today and judgment reserved. Assn and BSNL made convincing arguments before the Hon Court. As directed by the Hon CAT, Assn given written submission before the Court.
The main submissions are as follows: The applicants have no locus standi. The hierarchy in BSNL is as follows: JTO/JAO ---> SDE/AO ---> DE/AGM/CAO ---> DGM ---> SG DGM. The terms and condition for absorption in BSNL dated 02.09.2003 (Annexure IV) guarantee that all Executives would be eligible for promotion upto the level of Selection Grade Junior Administrative Grade (SG JAG). It is only to give effect to this assurance and guarantee that Foot No.2 to the Recruitment Rules has been specifically introduced. The terms and conditions of absorption are framed by BSNL consequent upon the order passed by the Principal Bench in O.A. No.298 of 2002 Dt 6-8-2002 filed by SNEA(I). The foot Note 2 appended to Schedule IA of the Recruitment Rules safeguards the interest of the existing incumbents holding the post of Executives on regular basis ie JTOs/ JAOs/ SDEs/ AOs etc on the date of notification of RRs who shall continue to be eligible for promotion to the grade of Divisional Engineer/Assistant General Manager/Chief Accounts Officer. In DOT and BSNL, qualification is insisted at the entry cadre only.
Further the Hon’ble Supreme Court of India has held in 1980 (3) SLR 1 and in AIR 1975 SC 1487 that the Note below the Rule is part of the Rule. The function of the Note is to provide the procedure and control the discretion. The real purpose of the Note is that when the Rules are silent, the Note will fill up the gaps.
PERSONAL PAY ISSUE OF NEWLY RECRUITED JTO’s IS RESOLVED: As promised by GM(F), Pune, the AO pay has given the effect of personal pay in the January month salary to the newly recruited JTO (i.e. 2007 batch and onwards). All of them are requested to verify the details and if any discrepancy is found to be bought to the notice of DS and the accounts wing with proper representation.

GS WRITES TO HON MOC & IT REGARDING LOSS MAKING RURAL SERVICES, BSNLS SOCIAL OBLIGATION AND DEMANDS GOVT SUPPORT AS ASSURED IN NTP 99: Government undermining singular efforts of BSNL in meeting its social obligations to build massive Country wide basic telecom infrastructure at incredibly huge costs in rural areas –continuing violation of one policy commitment after another to compensate it for incurring huge recurring losses to sustain rural operations in a fiercely competitive but non - existent level playing telecom market -- revenue from the rural land line services is about 1,048 Crores from 1.5 crores lines which works out an average revenue of just Rs 58 per line per month-- revenue from all other recoveries, including PCO, is about 1,696 Crores, with an average of Rs 94 per line per month -- On the contrary, the OPEX for the same period on rural lines was Rs 12,681 Crores, with an average expenditure of Rs 702 per line per month. This shows the huge gap between the cost on rural services and the revenue coming from them just to meet social commitments of the government. Private operators making loud noises about creation of level playing field have neither so far seen nor will ever see the light of these areas. Keeping in view the policy commitments of NTP 99 and other commitments of the government, the huge burden on BSNL because of its continued sole participation to provide land line services in highly loss making rural areas and also undertaking other activities towards fulfillment of the social obligations of the Govt. has to be assessed afresh, in a broader and holistic perspective and compensated suitably. <<Letter>>

PERSONAL PAY CASE OF THE NEWLY RECRUITED JTO’s: After a series of prolonged discussion and meetings with GM Finance Shri. Y.N. Singh, Shri. Awchar, CAO and Mrs. Patil AO staff, and after considering all the pro and cons of the issue, the GM finance has finally agreed to settle the issue of personal pay of the newly recruited JTO’s. The SNEA team led by the DS with Com. Mahanand Gaikwad, ADS, Com. Mukul Gandharv, JTO EB and Com. Ashish Mishra, JTO, EB provided the compete inputs to the finance wing and pleaded for correction. The GM finance has assured us that the personal pay would be credited in this month’s salary.
Now with the persuasion of SNEA(I), all the newly recruited JTO’s will get their right for the personal pay and get Rs. 4000/- their salary every month.

HON. HIGH COURT STAYS EXORBITANT CABLE LAYING CHARGES: The exorbitant charges charged by Pune Municipal Corporation for laying the cooper cables / OFC cables has been stayed by the Hon. High Court of Mumbai. This is an important decision for Pune SSS as all the new cable laying was almost halted due to very heavy charges i.e. 4500/- per meter, which made almost all the project unviable. IMPLEMENTATION OF MNP -- LESSONS FROM HARYANA CIRCLE: Till 24.12.2010, 31,000 subscribers have requested for porting out of BSNL. Only 2946 subscribers have ported into BSNL. Majority of the ported out subscribers are of high ARPU even in prepaid category. Main reasons for porting out, as intimated by them, are a) Network Problem (43.2%), b) Call Disconnected By Customer (14.4%). Due to High Rate -- only 8.9%.
